Recommended actions for e-mail for week ending 21 April 2010

This week’s actions are:

Environmental permitting:  those advising on requirements for environmental permits should note the new and updated guidance published by the Environment Agency and the Department for Environment, Food and Rural Affairs.

FOIA: information lawyers should note the recent Information Tribunal decision in Sikka v Information Commissioner, which sets out the factors that the Tribunal will consider when deciding whether to allow a late application to appeal a decision notice issued by the Information Commissioner under the Freedom of Information Act 2000.

Ordinary residence in Wales: anyone advising on the ordinary residence of someone in need of care in Wales should note that section 148 of the Health and Social Care Act 2008 came into force in Wales on 19 April 2010 making changes to what will need to be considered.

Licensing of park homes sites: in its response to a consultation on licensing park home sites, the Government announced its intention to set up a task force to consider licensing reforms.  Any local authority with a strong interest in this area may wish to consider applying to sit on the task force.

Public procurement: public procurement lawyers will be interested to note:

  • A recent Advocate General’s opinion stating that it was permissible for a contracting authority to require that tenderers hold a tax registration in the relevant member state, provided that the registration procedure did not act as a bar to the participation of a tenderer from another member state. 
  • That the European Commission has announced that it will be reviewing the public procurement regime.
